Cottage Food Operations
ASSEMBLY BILL 352
During the 2025 Nevada Legislative session AB352 regarding cottage food, cottage cosmetics, and craft foods was approved. This new law does not go into effect until JULY 2027. The Nevada Department of Agriculture will create regulations over the next two years and the programs will be under their jurisdiction beginning July 2027.
Cottage food operations continue to fall under the current law and the Southern Nevada Health District remains the registering authority for Clark County until July 2027. Information on the current law is below and on the FAQ page.
Cottage cosmetics registration does not go into effect until July 2027.
Craft food operations continue to fall under the jurisdiction of the Nevada Department of Agriculture until July 2027.
In May, 2013, the Nevada Legislature passed, and the Governor signed, the Cottage Food bill (SB206 PDF) which was incorporated into Nevada Revised Statutes (NRS) Chapter 446.866 allowing certain foods to be prepared and sold from a person’s home. SNHD is currently the registering authority for cottage foods made or sold in Clark County, NV.
A cottage food operation means a natural person who manufactures or prepares food items in a non-permitted food establishment setting for sale directly to an end consumer. Gross sales from a cottage food operation may not exceed $35,000 annually. There are limitations on where, how, and to whom cottage foods can be sold. REGISTRATION PROCESS
- Submission:
- The Cottage Food Operation Registration Application must be completed and signed by the owner of the business. Incomplete applications will not be processed.
- E-mail the completed application to regsupport@snhd.org.
- Agreement to Process Application:
- The application will be reviewed in the order in which it is received.
- SNHD will contact you if there are any questions about your application, if more information is needed, or with the reason the application cannot be processed.
- If you choose to have an SNHD label review, you will be contacted and invoiced separately.
- If the application can be approved, a Cottage Food Operation Registration Agreement will be sent to you to review and sign.
- Pay fees:
- When the agreement is returned, an account will be created and an invoice will be sent for a one-time, non-refundable cottage food registration fee with instructions for payment. The current registration fee is on the EH
- The cost of a cottage food operation registration is on the last page of the Environmental Health Fee Schedule which is updated annually on July 1st under “MISCPR – COTTAGE FOOD OPERATION REGISTRATION”.
- If the invoice is not paid within 30 days, the application will be denied as a delinquent account. Any future applications for registration from the same person will be denied until the account is brought into financial compliance.
- When the agreement is returned, an account will be created and an invoice will be sent for a one-time, non-refundable cottage food registration fee with instructions for payment. The current registration fee is on the EH
- Registration letter:
- After the fee has been paid, an approval letter will be sent. The cottage food operation is not registered and cannot operate until the approval letter has been received.
