Public Health Update: Solid Waste Management Authority Hearing Officer Meeting

October 9, 2014

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the October 9, 2014 hearing, the following cases were adjudicated:

I. Matters Requiring Hearing Officer Action

A. Notices of Violation with Contested Facts

  1. 1. J. Socorro Huerta-Jara – NOV #SW14-760/R2) For disposing of, abandoning or dumping motor vehicle battery, motor vehicle tire or motor vehicle oil at a site which has not been issued a permit for that purpose on or about May 29, 2014. (for possible action)Hearing officer found J. Socorro Huerta-Jara in violation and imposed a penalty of $900.
  2. Branbert Investments LLC – NOV #SW14-240/N7- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 19, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on February 26, 2014 with extensions of the Order deadline extended to June 2, 2014. (for possible action)Hearing officer found Branbert Investments LLC in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
  3. Jose M. Sanchez and Maria M. Sanchez – NOV #SW14-520/H2- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about April 24, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on April 30, 2014. (for possible action)Item continued to November 13, 2014 agenda.
  4. Jose M. Sanchez and Maria M. Sanchez – NOV #SW14-544/R2- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about April 24, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on April 30, 2014. (for possible action)Item continued to November 13, 2014 agenda.
  5. Kimlong, LLC dba Pho Kim Long II – NOV #SW14-937/R2) For placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 4023 Spring Mountain Road, Clark County, Nevada on or about July 8, 2014. (for possible action)Hearing officer found Kimlong, LLC dba Pho Kim Long II in violation and imposed a penalty of $500. Failure to comply will result in the original penalty of $900 as initially sought in the Notice of Violation.
  6. Arturo and Eufemia Lucero –NOV #SW13-1538/A0- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about December 10, 2013; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on December 18, 2013, with extensions of the Order extended to March 4, 2014. (for possible action)Hearing officer found Arturo and Eufemia Lucero in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
  7. Pei Wei Asian Diner, LLC dba Pei Wei Asian Diner #45 – NOV #SW14-303/A0- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 20, 2014; 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 10830 West Charleston Boulevard, Suite #110, Las Vegas, Clark County, Nevada on or about February 20, 2014; and 3) failure to comply with the Order issued by the Solid Waste Management Authority on February 20, 2014. (for possible action)Hearing officer found Pei Wei Asian Diner, LLC dba Pei Wei Asian Diner #45 in violation of 3) and imposed a penalty of $900.
  8. Alvin and Jenny Au Revocable Trust – NOV #SW14-144/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 27, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on February 6, 2014. (for possible action)Item withdrawn by the Southern Nevada Health District.
  9. Equisource, LLC – NOV #SW14-789/C6- For 1– operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about May 30, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on June 5, 2014. (for possible action)Hearing officer found Equisource, LLC in violation of 2) and imposed a penalty of $500. Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
  10. Carlos Alberto Huidobro – NOV #SW13-880/E0/C6-For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on April 10, 2014. (for possible action)Item withdrawn by the Southern Nevada Health District.
  11. Dayco Funding Corporation – NOV #SW14-125/C6/C6– For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on June 12, 2014. (for possible action)Item withdrawn by the Southern Nevada Health District.
  12. Anacole Holdings, LLC – NOV #SW14-290/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 2, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on February 21, 2014 with extension of the Order deadline extended to April 7, 2014. (for possible action)Item continued to November 13, 2014 agenda.

B. NON-CONTESTED NOTICES OF VIOLATION: The Hearing Officer may approve or disapprove the agreed resolution. Upon disapproval of the agreed resolution, the Hearing Officer will set a date for the hearing of any such Notice of Violations.

  1. Rugged Oaks Investments, LLC – NOV #SW14-116/C6/C6) For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on June 12, 2014. (for possible action) Hearing officer found Rugged Oaks Investments, LLC in violation and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $2,800 as initially sought in the Notice of Violation.

C. NOTICES OF VIOLATION – FURTHER PROCEEDINGS

  1. Lori C. Feichko – NOV #SW14-333/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located south of the intersection of South Rumrill Street and West Patrick Lane, Clark County, Nevada on or about March 3, 2014. (for possible action)Hearing officer order of July 15, 2014 is vacated.
