Solid Waste Management Authority Hearing Officer Meeting

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the May 8, 2014 hearing the following cases were adjudicated:

I. Matters Requiring Hearing Officer Action

A. Notices of Violation with Contested Facts

  1. Performance Contracting Incorporated – NOV #SW14-626/R2- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about April 22, 2014; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 3630 South Highland Drive, Clark County, Nevada on or about April 22, 2014. (for possible action)Item continued to September 11, 2014 agenda.
  2. CAB Properties, LLC – NOV #SW13-1350/G9- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about October 15, 2013; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on October 28, 2013 with extensions of the Order deadline extended to March 17, 2014. (for possible action)Hearing officer found CAB Properties, LLC in violation and imposed a penalty of $900 fore 1) and a penalty of $1,400 for 2). Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.
  3. Las Vegas Walnut LLC and PFF Trust – NOV #SW13-473/K5- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about April 3, 2013; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on June 21, 2013 with extensions of the Order deadline extended to January 15, 2014. (for possible action)Hearing officer found Las Vegas Walnut LLC and PFF Trust in violation and imposed a penalty of $1,000 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $4,000 as initially sought in the Notice of Violation.
  4. IGWT Investments LLC – NOV #SW14-022/K5- For 1) causing or allowing sewage or accumulation of human excreta to overflow on property located at 355 East Larson Lane, Henderson, Clark County, Nevada on or about January 8, 2014 and February 19, 2014; and and 2) failure to comply with the Orders issued by the Solid Waste Management Authority on January 8, 2014 and February 19, 2014. (for possible action)Hearing officer found IGWT Investments LLC in violation and imposed a penalty of $1,000 for each of 1) and 2). A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $3,600 as initially sought in the Notice of Violation.
  5. Alma Garcia and Thomas Conley – NOV #SW04-299/K5- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 20, 2014; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located northeast of 6705 Vegas Valley Drive, Clark County, Nevada on or about February 20, 2014. (for possible action)Hearing officer found Alma Garcia and Thomas Conley in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.
  6. Jerry Beasley – NOV #SW14-219/K5- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 10, 2014; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located at the northwest corner of Delano Drive and Leadville Road, Henderson, Clark County, Nevada on or about February 10, 2014. (for possible action)Item withdrawn by the Southern Nevada Health District.
  7. Daley Family Trust and Vincent and Michele Paglia Trust – NOV #SW14-080/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 8, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on January 27, 2014 with extensions of the Order deadline extended to April 28, 2014. (for possible action)Hearing officer found Daley Family Trust and Vincent and Michele Paglia Trust in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
  8. Decatur-Rice, LLC – NOV #SW14-406/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about March 19, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on March 26, 2014. (for possible action)Item continued to September 11, 2014 agenda.
  9. Chieftain Meranto Retail LLC – NOV #SW13-1328/C6/C6– For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on March 13, 2014. (for possible action)Item withdrawn by the Southern Nevada Health District.
  10. Tran Enterprises, LLC – NOV #SW13-1213/C6/C6– For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on March 13, 2014. (for possible action)Hearing officer found Tran Enterprises, LLC in violation and imposed a penalty of $2,800. Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the maximum allowed penalty of $5,000.
  11. Tran Enterprises, LLC – NOV #SW13-1335/C6/C6– For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on March 13, 2014. (for possible action)Hearing officer found Tran Enterprises, LLC in violation and imposed a penalty of $2,800. Corrective action of removal and proper disposal of waste is ordered. Failure to comply will result in the maximum allowed penalty of $5,000.
  12. Tran Enterprises, LLC – NOV #SW14-346/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about February 10, 2014; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on March 7, 2014. (for possible action)Hearing officer found Tran Enterprises, LLC in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.
  1. NON-CONTESTED NOTICES OF VIOLATION: The Hearing Officer may approve or disapprove the agreed resolution. Upon disapproval of the agreed resolution, the Hearing Officer will set a date for the hearing of any such Notice of Violations.
  1. Ray Lindsey – NOV #SW14-574/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about April 4, 2014; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 2204 Carter Circle, Clark County, Nevada on or about April 4, 2014. (for possible action)Hearing officer found Ray Lindsey in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
  2. Pacific Southwest Coronado Resort Properties III, LLC – NOV #SW14-431/N7- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about March 28, 2014; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located south of 7777 South Jones Boulevard, Clark County, Nevada on or about March 28, 2014. (for possible action)Hearing officer found Pacific Southwest Coronado Resort Properties III, LLC in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
