Solid Waste Management Authority Hearing Officer Meeting

May 8, 2014

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the May 8, 2014 hearing the following cases were adjudicated:

I. Matters Requiring Hearing Officer Action

A. Notices of Violation with Contested Facts

  1. Adam Barber and Erika Barber – NOV #SW13-1493/K5- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about November 18, 2013; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 1707 South Sloan Lane, Clark County, Nevada on or about November 18, 2013. (for possible action)

    Hearing officer found Adam Barber and Erika Barber in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

  2. Sunstate Companies, Inc. – NOV #SW13-1026/A0- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about August 13, 2013; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located on the south side of West Torino Avenue between 11255 West Torino Avenue and 11181 Wet Torino Avenue, Clark County, Nevada on or about August 13, 2013. (for possible action)

    Item continued to June 12, 2014 agenda.

  3. Gourley Melendrez Enterprises, LLC – NOV #SW14-119/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 28, 2014; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located north of 8150 Blue Diamond Road, Clark County, Nevada on or about January 28, 2014. (for possible action)

    Hearing officer found Gourley Melendrez Enterprises, LLC in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

  4. Toros Yeranosian – NOV #SW13-973/G9/C6- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on January 9, 2014. (for possible action)

    Hearing officer found Toros Yeranosian in violation and imposed a penalty of $2,800. Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

B. Non-Contested Notices of Violation: The Hearing Officer may approve or disapprove the agreed resolution. Upon disapproval of the agreed resolution, the Hearing Officer will set a date for the hearing of any such Notice of Violations.

  1. Al Loo – NOV #SW14-121/N7- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 28, 2014; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located east of the corner of West Oquendo Road and South Tomsik Street, Clark County, Nevada on or about January 28, 2014. (for possible action)

    Hearing officer found Al Loo in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

  2. Dolphin Winder, LLC – NOV #SW14-073/N7- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about January 21, 2014; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 6420 Cameron Street, Clark County, Nevada on or about January 21, 2014. (for possible action)

    Hearing officer found Dolphin Winder, LLC in violation and imposed a penalty of $900 for each of 1) and 2). A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

  3. Afredalia Serna – NOV #SW13-1620/K5- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about December 15, 2013; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste within the Clark County Flood Channel located north of 6042 Pumpkin Patch Avenue, Clark County, Nevada on or about December 15, 2013. (for possible action)

    Hearing officer found Afredalia Serna in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

C. Notices of Violation – Further Proceedings
