Public Health Update: Solid Waste Management Authority Hearing Officer Meeting

FOR IMMEDIATE RELEASE:
April 10, 2014

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the the April 10, 2014 hearing, the following cases were adjudicated:

I. Matters Requiring Hearing Officer Action

A. Notices of Violation with Contested Facts

1. Carlos Alberto Huidobro – NOV #SW13-880/E0- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about July 16, 2013; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located at 4037 North Tee Pee Lane, Las Vegas, Clark County, Nevada on or about July 16, 2013. (for possible action)

   Hearing officer found Carlos Alberto Huidobro in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

2. R.J.R.J, L.L.C. – NOV #SW13-1432/G9- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about October 31, 2013; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on November 8, 2013. (for possible action)

   Hearing officer found R.J.R.J., LLC in violation of 1) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

3. Brian David Lesk – – NOV #SW13-1517/A0- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about December 13, 2012; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located on the Public Right-of-Way on the east side of Copper Sage Street approximately 1,860 feet south of Smiley Road, and the vacant parcel located at 2670 Betty Lane, Clark County, Nevada on or about December 13, 2012. (for possible action)

   Item withdrawn by the Southern Nevada Health District

4. Cesar Meza, Martin Meza, and Armida Soto-Acosta – NOV #SW13-1323/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about October 16, 2013; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located north of 9445 South Fort Apache Road, Clark County, Nevada on or about October 16, 2013. (for possible action)

   Hearing officer found Cesar Meza, Martin Meza, and Armida Soto-Acosta in violation and imposed a penalty of $900 for each of 1) and 2). A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

5. Gragson-Buffalo Windmill – NOV #SW13-1366/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about October 23, 2013; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on October 28, 2013. (for possible action)

   Hearing officer found Gragson-Buffalo Windmill in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

6. Letha Davies – NOV #SW13-419/H2/C6- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on November 14, 2013. (for possible action)

   Item continued to July 15, 2014 agenda.

B. Non-Contested Notices of Violation: The Hearing Officer may approve or disapprove the agreed resolution. Upon disapproval of the agreed resolution, the Hearing Officer will set a date for the hearing of any such Notice of Violations.

1. True Colors, Inc. DBA Integrity Customs – NOV #SW13-1582/32- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about November 21, 2013; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the Public Right-of-Way on the southeast side of 253 Elliott Road, Henderson, Clark County, Nevada on or about November 20, 2013. (for possible action)

   Hearing officer found True Colors, Inc. dba Integrity Customs in violation of 2) and imposed a penalty of $750. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

2. Juston Ivan Wright – NOV #SW13-1488/32- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about November 16, 2013; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located southeast of Owens Avenue on Morning Sun Way, Clark County, Nevada on or about November 16, 2013. (for possible action)

   Hearing officer found Juston Ivan Wright in violation of 2) and imposed a penalty of $500. A Cease and Desist order is issued to stop operating a solid waste disposal site without a permit from the solid waste management authority at this location or any other in Clark County, Nev.

3. Flamingo Las Vegas Operating Company, LLC – NOV #SW13-818/A0- For 1) causing or allowing sewage or accumulation of human excreta to overflow on property located at 3555 South Flamingo Road, Clark County, Nevada on or about June 25, 2013, June 26, 2013, June 27, 2013, July 4, 2013, July 9, 2013 and July 10, 2013; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on June 25, 2013 with extensions of the Order deadline extended to August 19, 2013. (for possible action)

   Hearing officer found Flamingo Las Vegas Operating Company, LLC in violation and imposed a penalty of $8,400 for 1) and $7,000 for 2).

4. Las Vegas Land Development Company LLC – NOV #SW13-1478/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority on or about November 14, 2013; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on November 22, 2013. (for possible action)

   Item withdrawn by the Southern Nevada Health District.

C. Notices of Violation – Further Proceedings

1. Tran Enterprises, LLC – NOV #SW13-466/C6- For 1) operating a disposal site in Clark County, Nevada, without a permit issued by the solid waste management authority; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on April 29, 2013.  (for possible action)

Hearing officer order dated January 9, 2014 is vacated.
