Solid Waste Management Authority Hearing Officer Meeting

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the June 17, 2009 the following cases were adjudicated:

II. Matters Requiring Hearing Officer Action

A. Notices of Violation with Contested Facts

1. Yvonne Skrzeczyna – NOV #SW09-278/C0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 313 Sea Rim Avenue, Clark County; on or about December 22, 2008.

   Hearing officer found Yvonne Skrzeczyna in violation of 2) and imposed a penalty of $750. Corrective action of removal and proper disposal of waste is ordered. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

2. Dalana Lynn Jorgensen and Casey Jorgensen – NOV #SW09-420/47- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 4060 North Juliano Road, Clark County; on or about March 14, 2009.

   Hearing officer found Dalana Lynn Jorgensen and Casey Jorgensen in violation of 1) and imposed a penalty of $500.

3. A-1 Concrete Cutting & Demolition, LLC – NOV #SW09-459/47- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located at the southeast corner of Elkhorn Road and Clayton Street, North Las Vegas, Clark County; on or about March 23, 2009.

   Hearing officer found A-1 Concrete Cutting & Demolition, LLC in violation and imposed a penalty of $500 for each of 1) and 2).

4. Paul J. Vadnais – NOV #SW09-461/47- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant 2.41 acre parcel located at the northeast corner of Elkhorn Road and Clayton Street, North Las Vegas, Clark County; on or about March 23, 2009.

   Item withdrawn by the Southern Nevada Health District.

5. Adrian Ramos-Monjaras and Laura Ramos-Monjaras – NOV #SW09-324/G9- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon property located at 2148 Bledsoe Lane, Clark County; on or about March 2, 2009.

   Hearing officer found Adrian Ramos-Monjaras and Laura Ramos-Monjaras in violation and imposed a penalty of $900 for each of 1) and 2). Correction action of removal and proper disposal of waste is ordered.

6. Giovanni G. Galecio and Yamileth Bohorquez-Acosta – NOV #SW09-430/C6- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste consisting of rolls of carpet and padding upon the vacant parcel located approximately 150 feet from the east end of Vegas Valley Drive, Clark County; on or about March 18, 2009.

   Hearing officer found Giovanni G. Galecio and Yamileth Bohorquez-Acosta in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

7. Real Tree Landscape and Design and Ryan Barber – NOV #SW09-270/32- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located on the north end of Van Allen Street, Clark County; on or about February 13, 2009.

   Hearing officer found Real Tree Landscape and Design and Ryan Barber in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

8. Cary Lee Rider – NOV #SW09-402/G9- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at the southwest corner of Lucerne Street and Nevada Avenue, Clark County; on or about December 18, 2008.

   Item continued to July 15, 2009 agenda.

9. Jose R. Maldonado and Nellie H. Maldonado – NOV #SW08-1854/G9- For 1) operating a disposal site without a permit issued by the solid waste management authority; 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 5274 Hagemann Lane, Clark County; on or about December 9, 2008; and 3) failure to comply with the Order issued by the Solid Waste Management Authority on December 11, 2008.

   Hearing officer found Jose R. Maldonado and Nellie H. Maldonado in violation and imposed a penalty of $900 for each of 1), 2) and 3).

10. Edward John Puga – NOV #SW09-029/E0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on January 9, 2009.

    Hearing officer found Edward John Puga in violation and imposed a penalty of $750 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

11. Impact Trucking LLC – NOV #SW09-489/C6- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon Rose Quartz Road located between Paradise Hills Drive and San Salvador Road, Henderson, Clark County; on or about March 30, 2009.

    Hearing officer found Impact Trucking LLC in violation of 2) and imposed a penalty of $500.

12. William Stiffler – NOV #SW09-328/C6- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the property located at 1520 Quarter Horse Drive, Henderson, Clark County; on or about February 26, 2009.

    Hearing officer found William Stiffler in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

13. Boulder Village, LLC – NOV #SW09-202/C6- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on February 5, 2009.

    Hearing officer found Boulder Village, LLC in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

14. Kyle Acquisition Group, LLC – NOV #SW08-1057/A0- For 1) operating a disposal site without a permit issued by the solid waste management authority; 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on four properties located south of the intersection of Oso Blanca Road and Kyle Canyon Road, Las Vegas, Clark County; on or about June 13, 2008; 3) disposing of, abandoning or dumping a motor vehicle battery, motor vehicle tire or motor oil at a site which has not been issued a permit for the purpose on or about November 16, 2008; and 4) failure to comply with the Order issued by the Solid Waste Management Authority on July 16, 2008.

    Item continued to July 15, 2009 agenda.

15. Robert D. Strimling and Family Trust and Robert Strimling and Debra Strimling Trustees – NOV #SW09-098/C0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on January 27, 2009.

    Hearing officer found Robert D. Strimling and Family Trust and Robert Strimling and Debra Strimling Trustees in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

16. The Ridges III, 1 LLC – NOV #SW08-1482/60/23- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on February 18, 2009.

    Hearing officer found The Ridges III, 1 LLC in violation and imposed a penalty of $3,200. Corrective action of removal and proper disposal of waste is ordered.

17. Ramiro Ramirez – NOV #SW09-280/08- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located north of East Alto Street, Clark County; on or about February 18, 2009.

    Item withdrawn by the Southern Nevada Health District.

B. Non-Contested Notices of Violation: The Hearing Officer may approve or disapprove the agreed resolution. Upon disapproval of the agreed resolution, the Hearing Officer will set a date for the hearing of any such Notice of Violations.

1. Rick Tasler dba SASCO, Inc. – NOV #SW08-1732/G7- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on November 26, 2008.

   Hearing officer found Rick Tasler dba SASCO, Inc. in violation and imposed a penalty of $900 for 1) and a penalty of $750 for 2).

2. Clifford L. Hopper – NOV #SW09-364/60- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant property located south of east Vegas Valley Drive, Clark County; on or about March 4, 2009.

   Hearing officer found Clifford L. Hopper in violation of 2) and imposed a penalty of $900. Corrective action of removal and proper disposal of waste is ordered. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.

3. Spinnaker Homes V, LLC – NOV #SW09-101/E0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on January 29, 2009.

   Hearing officer found Spinnaker Homes V, LLC in violation of 2) and imposed a penalty of $900. Corrective action of removal and proper disposal of waste is ordered. Failure to comply will result in the original penalty of $1,800 as initially sought in the Notice of Violation.
