Solid Waste Management Authority Hearing Officer Meeting

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the February 21, 2007 meeting, the following cases were adjudicated:

II. Matters Requiring Hearing Officer Action

A. Notices of Violation with Contested Penalties:

  1. Caroline Malbrough – NOV #SW06-1344/A8- For 1) operating a disposal site without a permit issued by the solid waste management authority; 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 2326 Pariva Street, Las Vegas, Clark County; on or about September 26, 2006; and 3) failure to comply with the Order issued by the Solid Waste Management Authority on September 27, 2006.

    Item continued to March 21, 2007 agenda.

  2. Tracy Snider also known as Tracy Vaccaro and El Dorado Equestrian Center – NOV #SW05-723/24/74/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on August 16, 2006.

    Item withdrawn by the Southern Nevada Health District.

B. Notices of Violation with Contested Facts:

  1. RMI Management, LLC – NOV #SW06-1559/A8- For 1) operating a disposal site without a permit issued by the solid waste management authority.

    Item continued to April 18, 2007 agenda.

  2. Greg Adams – NOV #SW06-1297/23- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at GPS coordinates N 35º 48’ 10.9” W 114º 54’ 50.9” which is south of milepost 4.0 on State Route 165, Boulder City, Clark County; on or about September 14, 2006.

    Hearing officer found Greg Adams in violation of 2) and imposed a penalty of $500. Corrective action of removal and proper disposal of waste is ordered. Failure to comply will result in the initial penalty of $1,800 as initially sought in Notice of Violation.

  3. Nevada Environmental Care, Inc. and Andre N. Nelms – NOV #SW06-1775/62- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste upon the vacant parcel located off of Maule Avenue approximately 600 feet from Spencer Street, Clark County; on or about December 13, 2006.

    Item withdrawn by the Southern Nevada Health District.

  4. Norma McCall – NOV #SW06-1774/E0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste in the southeast corner of a vacant lot, approximately 20 acres in size, bordered by East Pyle Avenue, Dave Street, Stinnet Street and Spencer Street, near the intersection of Viterbo Avenue and Dave Street, Clark County; on or about December 11, 2006.

    Item withdrawn by the Southern Nevada Health District.

  5. Sunset Oasis Landscaping, LLC and Brandon Carl Collins – NOV #SW06-1739/60- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 897 Morning Sun Court, Clark County; on or about December 11, 2006.

    Hearing officer found Sunset Oasis Landscaping, LLC and Brandon Carl Collins in violation and imposed a penalty of $1,500 for each of 1) and 2).

  6. Desert Buffalo CVS, L.L.C. – NOV #SW06-1761/23- For 1) causing or allowing sewage or accumulation of human excreta to overflow on property located at 3270 South Buffalo Drive, Clark County, on or about December 9, 2006; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on December 9, 2006.

    Item continued to April 18, 2007 agenda.

  7. Johnn L. Travis – NOV #SW06-1803/E0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 3771 Glen Avenue, Clark County; on or about December 20, 2006.

    Hearing officer found Johnn L. Travis in violation of 1) and imposed a penalty of $1,000. Failure to comply will result in the original penalty of $3,000 as initially sought in Notice of Violation.

  8. Michael Vancleef – NOV #SW06-1525/62- For 1) operating a disposal site without a permit issued by the solid waste management authority; 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 2744 Quebec Court, Clark County; on or about October 30, 2006; and 3) failure to comply with the Order issued by the Solid Waste Management Authority on October 30, 2006.

    Item continued to April 18, 2007 agenda.

  9. Flamingo Paradise Partners, LLC and Boreta Vaso 2000 Trust – NOV #SW06-1080/62- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on October 23, 2006.

    Hearing officer found Flamingo Paradise Partners, LLC and Boreta Vaso 2000 Trust in violation of 2) and imposed a penalty of $750.

  10. Moulin Rouge Development Corporation, Rod Bickerstaff, and Dale L. Scott – NOV #SW06-1319/A8- For 1) causing or allowing sewage or accumulation of human excreta to overflow on property located at 920 West Bonanza Road, Las Vegas, Clark County, on or about September 18, 2006; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on September 18, 2006, and October 6, 2006.

    Hearing officer found Moulin Rouge Development Corporation, Rod Bickerstaff, and Dale L. Scott in violation and imposed a penalty of $2,000 for 1) and a penalty of $13,440 for 2). Corrective action of remediation of the area affected by sewage overflow is ordered. Failure to comply will result in a penalty of $19,300 as initially sought in Notice of Violation.

  11. Javier Jesus Castellon and Chuy’s Landscape – NOV #SW06-047/B6/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on August 16, 2006.

    Hearing officer found Javier Jesus Castellon and Chuy’s Landscape in violation and imposed a penalty of $2,000. Corrective action of removal and proper disposal of waste is ordered.

C. Non-Contested Notices of Violation: The Hearing Officer may approve or disapprove the agreed resolution. Upon disapproval of the agreed resolution, the Hearing Officer will set a date for the hearing of any such Notice of Violations.
