Solid Waste Management Authority Hearing Officer Meeting

December 20, 2006

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 44.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the December 20, 2006 meeting, the following cases were adjudicated:

A. Notices of Violation with Contested Penalties:

B. Notices of Violation with Contested Facts:

1. Ford Contracting, Inc. – NOV #SW06-480/B6- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located on the southwest corner of Russell Road and Buffalo Drive, Clark County; on or about April 20, 2006.

   Item continued to January 17, 2007 agenda.

2. Wright Brothers Tile, Inc. – NOV #SW06-644/21- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on the vacant land located south of the interpretive site turn, off of Lake Mead Boulevard, Clark County; on or about May 24, 2006.

   Hearing officer found Wright Brothers Tile, Inc. in violation and imposed a penalty of $1,440 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered. Failure to comply will result in the original penalty of $3,600 as initially sought in November.

3. Marsha Lynn Thornley – NOV #SW06-519/A0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 4810 West Lone Mountain Road, Las Vegas, Clark County; on or about April 28, 2006.

   Hearing officer found Marsha Lynn Thornley in violation and imposed a penalty of $900 for each of 1) and 2).

4. John M. Swangler – NOV #SW06-684/B6- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on the vacant parcel located south of 9190 West Naples Drive, Clark County; on or about June 2, 2006.

   Hearing officer found John Swangler in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

5. Tamara Nelson and Brandon James Nelson – NOV #SW06-792/23- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located northeast of the intersection of Cape Horn Drive and Courier Street, Henderson, Clark County; on or about June 26, 2006.

   Hearing officer found Tamara Nelson and Brandon James Nelson in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action to provide proof of removal and proper disposal of waste is ordered.

6. Alexis Alvarez – NOV #SW06-1318/60- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at the east side of Marauder Road, also known as Aviation Street, just north of East Craig Road, Clark County; on or about September 16, 2006.

   Hearing officer found Alexis Alvarez in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

7. Fastrack Unlimited, Inc. – NOV #SW06-1254/60- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at the northwest corner of Pioneer Way and Eldora Avenue, Clark County; on or about August 30, 2006.

   Hearing officer found Fastrack Unlimited, Inc. in violation and imposed a penalty of $1,800 for 1) and a penalty of $5,500 for 2).

8. Fastrack Unlimited, Inc. – NOV #SW06-1327/A8- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 6980 North Jones Boulevard, Las Vegas, Clark County; on or about September 25, 2006.

   Hearing officer found no violation.

9. Mei Ling Huang – NOV #SW06-1275/A8- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) failure to comply with the Order issued by the Solid Waste Management Authority on September 11, 2006.

   Item withdrawn by the Southern Nevada Health District.

10. Harrison Landscape Company, LLC – NOV #SW06-1054/A0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located approximately 600 feet west of Cimarron Road and approximately 60 feet south of Eldora Avenue, Clark County; on or about January 10, 2006.

    Hearing officer found Harrison Landscape Company, LLC in violation and imposed a penalty of $900 for each of 1) and 2). Corrective action of removal and proper disposal of waste is ordered.

11. Brandon Collins, Kimberlee Collins and Sunset Oasis Landscaping – NOV #SW05-894/27/74/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on June 21, 2006.

    Hearing officer found Brandon Collins, Kimberlee Collins and Sunset Oasis Landscaping in violation and imposed a penalty of $1,000. Corrective action to provide proof of removal and proper disposal of waste is ordered.

12. Brigido Duque and Carolyn Arafiles Solis – NOV #SW06-084/24/74/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on July 26, 2006.

    Item continued to January 17, 2006 agenda.

13. MSI Landscaping, Inc. – NOV #SW06-386/24/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on August 16, 2006.

    Item withdrawn by the Southern Nevada Health District.

14. Jose Bran – NOV #SW06-462/A8/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on June 21, 2006.

    Item withdrawn by the Southern Nevada Health District.

C. Non-Contested Notices of Violation: The Hearing Officer may approve or disapprove the agreed resolution. Upon disapproval of the agreed resolution, the Hearing Officer will set a date for the hearing of any such Notice of Violations.
