Solid Waste Management Authority Hearing Officer Meeting


Special Session – Continuance to August 17, 2005 Meeting

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At an August 29, 2005 continuance to the August 17, 2005 meeting, the following cases were adjudicated:

A. Non-Contested Notices of Violation:

None

B. Notices of Violation with Contested Penalties:

None

C. Notices of Violation with Contested Facts:

  1. Pro Star Drop Box Service, Inc. – NOV #SW05-088/19- For 1) operating a disposal site without a permit issued by the solid waste management authority on or about December 3, 2004 through June 30, 2005; 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 6131 North Hollywood Boulevard, Unincorporated, Clark County; on or about December 3, 2004, April 25, 2005, April 28, 2005, May 2, 2005, May 23, 2005, May 31, 2005, June 2, 2005, June 24, 2005 and June 27, 2005; 3) disposing of, abandoning or dumping a motor vehicle battery, motor vehicle tire or motor oil at a site which has not been issued a permit for the purpose on or about February 9, 2005, April 25, 2005, April 28, 2005, May 10, 2005, May 23, 2005, June 27, 2005, and June 30, 2005; and 4) failure to comply with the Order issued by the Solid Waste Management Authority on February 11, 2005.

    The hearing officer found Pro Star Drop Box Service, Inc. in violation of 1), 2) and 4), ordering an administrative penalty of $50,000 for 50 violations of 1), $15,500 for 9 violations of 2) and a $1,500 penalty for a single violation of 4). The total penalty is $67,000. In addition, the company is required to properly remove and dispose of the waste, and, under the supervision of a certified environmental manager, conduct a site assessment of the property and provide a written report to the Solid Waste Management Authority.

  2. Professional Star Construction, Inc. – NOV #SW05-545/19- For placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 6131 North Hollywood Boulevard, Unincorporated, Clark County; on or about December 3, 2004, April 25, 2005, April 28, 2005, May 2, 2005, May 23, 2005, May 31, 2005, June 2, 2005, June 24, 2005 and June 27, 2005.

    The hearing officer found Professional Star Construction, Inc. in violation, ordering an administrative penalty of $8,000 for 9 total violations. In addition, the company is required to remove and properly dispose of the waste.
