Solid Waste Management Authority Hearing Officer Meeting

The Solid Waste Hearing Officer, under authority granted in Nevada Revised Statute (NRS) 444.629, conducts monthly hearings to settle cases involving illegal dumping and other solid waste matters. At the May 18, 2005 meeting, the following cases were adjudicated:

A. Non-Contested Notices of Violation (NOV):

  1. Lawrence Allen Schweitzer, Gustavo Corrales, and Vegas Carpet Cleaning – NOV #HW05-002/A0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located on the vacant lot on the south side of Eldora Avenue approximately 1050 feet east from Durango Drive, Clark County; on or about January 27, 2005.

    The hearing officer found Lawrence Allen Schweitzer, Gustavo Corrales, and Vegas Carpet Cleaning in violation of 2) and 3), ordering an administrative penalty of $750 per violation, for a total penalty of $1,500. In addition, the parties must develop written procedures and an employee training program for industrial waste water. Failure to comply will result in an increase in the penalty to $2,700.

  2. Joseph N. Stevens, Jr. and S & S Moving, Inc. – NOV #SW05-146/A0- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at the south side of 4851 West Charleston Boulevard, Las Vegas, Clark County; on or about February 5, 2005.

    The hearing officer found Joseph N. Stevens, Jr. and S & S Moving, Inc. in violation of 1), ordering an administrative penalty of $750. In addition, the company must develop written procedures and an employee training program for the proper disposal of solid waste materials. Failure to comply will result in an increase in the penalty to $1,800.

  3. Gary Hunter – NOV #HW05-001/27 For 1) operating a disposal site without a permit issued by the solid waste management authority; 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 6731 West Alexander Road, Clark County; on or about January 26, 2005 and February 24, 2005.

    The hearing officer found Gary Hunter in violation of 2), ordering an administrative penalty of $1,000. In addition, the party must steam clean the trash vault and all gutters that were affected by the grease release, and provide a written action plan to prevent future occurrences.

B. Notices of Violation with Contested Penalities:

C. Notices of Violation with Contested Facts:

  1. Carmen Louise Haugland – NOV #SW04-1117/A0 For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on vacant property located 5 yards east of Los Feliz Street and 25 yards north of Valley Nails Lane, Clark County; on or about November 2, 2004.

    The hearing officer found Carmen Louise Haugland in violation of 2), ordering an administrative penalty of $700. In addition, the party must properly remove and dispose of the waste. Failure to comply will result in an increase in the penalty to $1,800.

  2. Chief Roofing, Inc. – NOV #SW05-191/27- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 6255 Park Street, Clark County; on or about February 17, 2005.

    The hearing officer found Chief Roofing, Inc. in violation of 1) and 2), ordering an administrative penalty of $1,000 per violation, for a total penalty of $2,000. In addition, the company must properly remove and dispose of the waste.

  3. John Goulding – NOV #SW04-1243/27- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at southwest corner of Helena Avenue and Durango Drive, Clark County; on or about December 21, 2004.

    The hearing officer found John Goulding in violation of 2), ordering an administrative penalty of $500. Failure to comply will result in an increase in the penalty to $2,500.

  4. Curtis Excavating, LLC – NOV #SW04-868/24/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on December 15, 2004.

    The hearing officer found Curtis Excavating, LLC in violation, ordering an administrative penalty of $3,000. In addition, the company is required to properly remove and dispose of the waste.

  5. Aaron Bradshaw – NOV #SW04-384/24/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on August 18, 2004.

    The hearing officer found Aaron Bradshaw in violation, ordering an administrative penalty of $2,500. In addition, the party must properly remove and dispose of the waste.

  6. Ma Angelica Sanchez – NOV #SW05-008/27- For 1) operating a disposal site without a permit issued by the solid waste management authority; and 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 1708 Verde Jardin Way, Clark County; on or about January 4, 2005.

    The hearing officer found Ma Angelica Sanchez in violation of 1) and 2), ordering an administrative penalty of $750 per violation, for a total penalty of $1,500.

  7. Las Vegas Auto Village, Inc. – NOV #HW04-018/45/74- For failure to comply with the Order issued by the Solid Waste Management Authority Hearing Officer on July 21, 2004.

    The hearing officer found Las Vegas Auto Village, Inc. in violation, ordering an administrative penalty of $2,500. In addition, the company must dispose of the waste under the supervision of a certified environmental manager.

  8. Rentex Charitable Services Division, Inc., and Aadvantage Appraisers, and David Van Hattem – NOV #SW04-873/45 For- 1) operating a disposal site without a permit issued by the solid waste management authority; 2) placing, depositing or dumping or causing to be placed, deposited or dumped solid waste on property located at 1875 East Sahara Avenue, Clark County; on or about August 17, 2004 and January 19, 2005; 3) disposing of, abandoning or dumping a motor vehicle battery, motor vehicle tire or motor oil at a site which has not been issued a permit for the purpose on or about August 17, 2004 and January 19, 2005; and 4) failure to comply with the Order issued by the Solid Waste Management Authority on August 25 and October 5, 2004.

    The hearing officer found Rentex Charitable Services Division, Inc., and Aadvantage Appraisers, and David Van Hattem in violation of 5), 6) and 7), ordering an administrative penalty of $500 per violation for a total penalty of $1,500. Failure to comply will result in an increase in the penalty to $7,000.
