Current Enforcement Activities

The Southern Nevada Health District is responsible for enforcement of the Nevada Clean Indoor Air Act (NCIAA). Health district staff conducts compliance checks during routine inspections and investigates complaints of violations.

The health district began the first phase of the enforcement process with an information and education campaign. Currently, the health district is identifying establishments with the most complaints and conducting investigations to verify violations of the provisions of the Act. Once violations are verified business owners are contacted to schedule a meeting with health district staff. The purpose of these meetings is to secure a compliance agreement with the establishments. If an agreement to comply cannot be secured, the health district plans to pursue civil actions against businesses in violation of the Act.

Since November 2006, the health district has received more than 2,000 complaints involving approximately 590 different establishments. Currently, the health district permits more than 16,000 food establishments in Clark County.

Compliance Agreements

In response to compliance letters sent by the health district, the businesses listed below scheduled conferences with health district staff to confirm abandonment of verified methods of undermining the Act:

These establishments have met with health district representatives and have agreed to comply with the Act as follows:

• Establishments that do not qualify as a casino or a stand-alone bar as defined by the Act must:
  • Post conspicuous signs at every entrance that clearly state smoking is prohibited.
  • Remove all ashtrays and other smoking paraphernalia from any area where smoking is prohibited.
    
    
• All ashtrays will be removed and staff will not provide any other receptacle for use as an ashtray to any person within the establishment.
  
  
• Bartenders and employees of each and every establishment will affirmatively advise persons who are smoking tobacco, who are preparing to smoke tobacco, or who ask for an ashtray or other receptacle, that smoking is prohibited inside the establishment and will direct patrons to smoke tobacco outside the establishment where an ashtray or other receptacle is provided.
